José Silva, Jr., is a former Assistant County Prosecutor, obtaining essential and vast experience prosecuting juvenile and adult matters, as well as prosecuting individuals who violated domestic violence restraining orders. As a former Assistant Prosecutor, José Silva, Jr., uses those skills and experiences in defending individuals charged with criminal offenses.
Superior court criminal matters, such as robbery, burglary, and sexual assault, are the type of cases handled by José Silva, Jr. Superior court criminal matters have a range of prison sentences, ranging from first (1st) degree, that has a maximum sentence of ten (10) to twenty (20) years, down to fourth (4th) degree, with the minimum sentence of eighteen (18) months.
Municipal court matters, such as simple assault, traffic tickets, city ordinances and driving under the influence of alcohol or a substance, are handled by José Silva, Jr.
Domestic violence matters are cases José Silva, Jr. handles for both the alleged victim and the alleged aggressor. To obtain a domestic violence restraining order, Super Court must determine that the aggressor violated NJSA 2C:25-19. This statute protects alleged victims from acts of domestic violence, that are, for example assault, kidnapping, sexual assault, criminal mischief, and other criminal acts.
